2. Acceptance of These Terms
By accessing our website, creating an account or placing an order, you agree to these Terms of Service and the policies referred to within them.
If you do not agree with these Terms, you should not use the website or place an order.
3. Website Use
You must not use our website:
- For an unlawful or unauthorised purpose
- To transmit viruses, malicious code or harmful material
- To interfere with the operation or security of the website
- To collect information about other users without authorisation
- To infringe our intellectual property rights or those of another person
- To provide false, misleading or fraudulent information
We may restrict or terminate access to the website where we reasonably believe these Terms have been breached.
4. Product Information
We take reasonable care to ensure that product descriptions, photographs, prices and other information are accurate. However, colours, packaging and product appearance may vary from what is displayed.
Product information provided on our website is general information and is not medical advice. Customers should follow the manufacturer’s instructions and seek advice from an appropriately qualified healthcare professional where necessary.
Where a product is identified as being for professional use, the purchaser is responsible for ensuring that it is purchased and used by an appropriately trained, qualified or authorised person.
Nothing in this section limits our obligations under the Australian Consumer Law.
5. Prices and Payment
All prices are displayed in Australian dollars. The applicable GST treatment and delivery charges will be displayed during checkout.
Payment must be successfully completed before an order is dispatched.
We may correct genuine pricing, description or availability errors. If an error affects an order already placed, we will contact you and offer the option to proceed with the corrected information or receive a refund.
6. Orders
Submitting an order does not guarantee that it has been accepted.
We may decline or cancel an order where:
- A product is unavailable
- There is an obvious pricing or description error
- Payment cannot be processed
- We reasonably suspect fraud or unauthorised activity
- Delivery is not reasonably available to the nominated address
- A product is subject to purchasing or regulatory restrictions
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled products.
7. Product Availability
Products are subject to availability. Some products may be dispatched from one of our Australian partner warehouses.
Where part of an order is unavailable or delayed, we may contact you to arrange a backorder, substitute product, partial delivery or refund.
We will not substitute a product without your agreement.
8. Shipping and Delivery
Shipping charges, delivery areas and estimated delivery periods are described in our Shipping Policy.
Delivery periods are estimates and may be affected by stock availability, public holidays, courier delays, weather events or circumstances outside our reasonable control.
Risk in the products passes to you when the products are delivered to the address provided with your order.
9. Returns, Refunds and Cancellations
Returns, refunds, replacements and order cancellations are handled according to our Refunds, Returns and Cancellations Policy.
That policy does not exclude or limit any rights available under the Australian Consumer Law.
10. Australian Consumer Law
Our products come with guarantees that cannot be excluded under the Australian Consumer Law.
You may be entitled to a repair, replacement, refund or other remedy if a product does not satisfy an applicable consumer guarantee.
Nothing in these Terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded.
11. Accounts and Customer Information
If you create an account, you are responsible for maintaining the confidentiality of your login information and for activity occurring through your account.
You must provide accurate and current order, delivery and contact information. We are not responsible for delays caused by inaccurate information supplied by the customer, except to the extent that responsibility cannot lawfully be excluded.
12. Intellectual Property
Unless otherwise stated, the website and its content—including text, graphics, photographs, branding and design—are owned by or licensed to Movement Health Supply.
You may view and use the website for personal or legitimate business purchasing purposes. You must not copy, reproduce, distribute or commercially exploit our content without prior written permission.
13. Reviews and Submitted Content
If you submit a review, comment or other content, you confirm that it is accurate, lawful and does not infringe another person’s rights.
We may moderate or remove content that is unlawful, misleading, offensive, irrelevant or otherwise inappropriate.
14. Third-Party Services and Links
Our website may contain links to third-party websites or use services provided by third parties, including payment, delivery and technology providers.
Third-party websites operate under their own terms and privacy policies. We are not responsible for third-party content or services except where responsibility cannot lawfully be excluded.
15. Privacy
Our collection, use and disclosure of personal information are described in our Privacy Policy.
By using the website or placing an order, you acknowledge that your information may be processed by Shopify and other service providers required to process payments, operate the store and fulfil deliveries.
16. Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising from use of the website.
This limitation does not apply where liability cannot lawfully be excluded or limited, including liability arising under the Australian Consumer Law.
17. Changes to These Terms
We may update these Terms where reasonably necessary to reflect changes to our business, website, products or legal obligations.
The updated Terms will be published on this page with a revised “Last updated” date. Changes will not remove rights that have already arisen under an existing order.
